The Future Competition Law Framework applicable to the Motor Vehicle sector

Target group

All citizens and organisations are welcome to contribute to this consultation. Contributions are particularly sought from stakeholders having direct experience with the application of the block exemption to the motor vehicle sector, such as the business community and consumer associations.

Objective of the request for stakeholder input

The current Motor Vehicle Block Exemption Regulation expires in May 2010.

In its Communication of 22 July 2009 the Commission set out its policy orientations about the future Competition framework applying to the markets for the sales of new motor vehicles and the markets for repair and maintenance services and spare parts. The Commission sought and received comments on these policy orientations.

With regard to this consultation, the Commission seeks in particular specific comments on the draft Regulation and the draft Guidelines

Reason why the consultation period is less than 8 weeks

The Commission has to adopt the successor Regulation before the expiry of the current Regulation in May 2009 and is obliged to invite the Advisory Committee one month in advance in order to present the modified draft taking into account the input from this consultation. Therefore the consultation period has to end at the 10 February at the very latest.

It should be noted that the Commission set out its future policy orientations in great detail in its Communication of 22 July 2009 which was followed by a public consultation at that time. The draft Regulation and draft Guidelines submitted for Consultation stay within the policy orientation which had been given in this Communication. As a consequence, all stakeholders have been well aware about the content of our proposal on substance and should be able to react quickly on the drafts.
