Judgment of the Court of Justice of the EU in the case Vent De Colère and Others (C-262/12) on State aid

On 19 December 2013, by François Biltgen, Judge at the Court of Justice of the EU, read the judgment C-262/12 Vent De Colère and Others on State aid.The Court of Justice of the EU ruled that the French mechanism for offsetting the additional costs arising from the obligation to purchase the electricity generated by wind turbines falls within the concept of an intervention by the State through State resources. The charges paid by final consumers of electricity, managed by the Caisse des dépôts et consignations, must be regarded as remaining under public control.
