Judgment of the Court of Justice of the EU in the joined cases X (C-199/12), Y (C-200/12) and Z (C-201/12) on Area of Freedom, Security and Justice

On 7 November 2013, Alexandra Prechal, Judge at the Court of Justice of the EU, read the judgment in the joined cases C-199/12 X, C-200/12 Y and C-201/12 Z on Area of Freedom, Security and Justice. The European Court of Justice stated that Homosexual applicants for asylum can constitute a particular social group who may be persecuted on account of their sexual orientation. In that context, the existence of a term of imprisonment in the country of origin sanctioning homosexual acts may constitute an act of persecution per se, provided that it is actually applied.
