Judgment of the Court of Justice of the EU in the case Asociaţia ACCEPT (C-81/12) on Social policy

On 25 April 2013, in the case 81/12 Asociaţia Accept v Consiliul Naţional pentru Combaterea Discriminārii, the European Court of Justice of the EU ruled that homophobic statements by the "patron" of a professional football club may shift the burden of proof on to the club to prove that it does not have a discriminatory recruitment policy. The appearance of discrimination on ground of sexual orientation may be refuted by a body of consistent evidence.
