EUROPEAN COURT OF FIRST INSTANCE JUDGMENT IN CASE “TILLACK V. COMMISSION”

Today, the European Court of First Instance in Luxembourg has made public its ruling in case T-193/04 Tillack v. Commission that concerns an investigation of the European Anti-Fraud Office (OLAF). The judgement and a press releaseAll available translations. are available on the Court’s website.

In reaction to the ruling, OLAF Director General Franz-Hermann Brüner stated: "The judgement confirms once again that OLAF does not act in a legal vacuum, but that its investigations are under effective judicial control.” He added: “In an area of law where, until now, case law has been very limited, the Court gives important guidance for the future work of OLAF."
