Beneficiaries of CAP payments (shared management)
The European Commission maintains this webpage to facilitate public access to information on beneficiaries of CAP payments (shared management) which are published on Member State websites.

Article 44a of Council Regulation (EC) No 1290/2005 as amended by Council Regulation (EC) No 1437/2007 and Commission Regulation (EC) No 259/2008 as amended by Commission Regulation (EU) No 410/2011 .

In its judgment of 9 November 2010 in Joined Cases C-92/09 and 93/09 concerning the obligation to publish information on the beneficiaries of European agricultural funds, the Court of Justice of the European Union concluded that publishing personal data relating to natural persons without drawing a distinction based on relevant criteria such as the periods during which those persons have received such aid, or the frequency or nature and amount thereof, is not proportionate. Consequently, the Court declared that the relevant provisions are invalid.
For reasons of transparency and pending the adoption by Parliament and Council of new rules taking account of the objections expressed by the Court, Regulation (EC) No 259/2008 has therefore been amended limiting the obligation to publish information on the beneficiaries of CAP payments to legal persons.
After an in-depth analysis and assessment in order to find the most appropriate way to reconcile the right to protection of personal data of the beneficiaries with the need for transparency, new provisions on the matter were published under Articles 111 – 114 of Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy.
The Commission is currently elaborating an implementing act laying down rules on the application of the new provisions.
